Hemp is recognized by the FSSAI as food
As of November 15th, 2021, hemp seeds and their by-products have been approved by the FSSAI and are 100% legal in India. The FSSAI has further permitted the free sale of hemp seeds and their by-products regarded as nutritional consumer products.
Legality & Conditions regarding Medical Cannabis in India
As mentioned in the NDPS Act, Cannabis extracts containing beyond 0.3% of THC are still considered illegal in India. An individual is only permitted to grow or use these extracts upon receiving the necessary license from the relevant authority.
Legality & Licensing regarding Industrial Hemp
As clearly stated in the NDPS Act of 1985, Chapter 3, Section 14 — State governments are granted special authority to issue licenses for the cultivation and processing of Cannabis for fiber and seeds for industrial and horticultural usage.
